If you see the number of application pending in EB2 ROW for 2007 and 2008 they are huge compared to previous years somewhere in hundereds which can mean having the above said issues. The number of applications related to the above mentioned issues cannot spike significantly in just 2007 and 2008. Either the data is old and can mean that these applications are processed and approved and we wait until the new data is posted.
You can compare this with the PERM data. PERM data has very low EB2 ROW application in a given year and hence has always remained current.

I think it should be based on how long they have paid tax (say 5 years). For example, for those who have been legally working for more thena 5 years and paid tax during the period, with labor and I140 approved, they should allow them to file I485 right away. :D
I always feel allowing illegals become legals is a huge advance for them. For legal H1Bs, the only advance of similar magnitute is giving them GC without any delay (at least within a timeframe comparable to those illegals becoming legals).

After reading through the forums, I understand the EB3-World needs to become current for any others to move forward.
But now I notice that EB3-World itself has stopped moving after jumping for some months. Any reasons? (The 245i is already cleared and now it is in Aug 02)

Discrimination in employment based on nationality is not allowed. However, can we extend the argument to the employment based immigration? We can always choose to take that promotion though we will lose our place in the queue.
Leaving the question of fairness aside, under the current legal framework my guess is we do not have a case.

Depending on which country you are from, it may seem like discrimination or fair system upholding diversity.
If you are from India, you would hate it. There are truckloads of programmers in that country. But if you are the only graduate with programming skills from a country like timbaktoo (?), you would love it. You also got a shot at american dream.

Sonia held back MMS's hand. She had him appoint the National Advisory Council (NAC) (apart from list of other councils and Congress constitutional changes that she made so the power lies directly in her hands)under her chairmanship with statutory powers to oversee the the reforms.
It's easy to blame the allies it's tough to suck in the truth when you as an individual have vested interest and not Nation's interest in mind.
All these vested interests of different individuals are the rungs of Sonia's ladder.In that sense alone she and her family are in
the right place right time.

Please experts on Canada vs US situation help with this.
A person lets say makes 100000 in US. His approx take home (after tax) would be lets say 70000, right? How much would he have to make in canada (Montreal) to keep par or do better than the salary in US. This is to understand the tax structure. Please try to give atleast three scenarios--

You need DOB certificate at I 485. I am not sure whether Police Certificate is needed at 485 stage or not. What I am curious is will the USCIS accept DOB certificate from the Indian Embassy or would require it back from the applicants place of birth. A person whom I know has recently requested for DOB certificate and it took almost 45 days in his native place in India.

Neither of us are lawyers and I wouldn't even bother reading what you wrote. All I can say is, why don't you ask your immigration lawyer about this Class Action. Let's see what he says.

Forget about considering, you won't even read a post with a different pov... (makes me wonder why you bother with the forum if even reading a post is too much work.)
My own attorney, as a matter of fact, thinks that a class action makes sense in this instance.
As lazycis points out, his attorney didn't want him to even file an individual WOM, and it turned out his attorney was absolutely wrong. The mass of evidence in WOM cases and the current Mocanu decision shows that lazycis's attorney (and other let us not disturb/question the status quo attorneys) were wrong. I should remind people again that most of our attorneys are not litigators, they are paper filers -- this dichotomy is true in most other practice areas of the law (eg: antitrust) as well.
The reason I care about this is -- if people/attorneys make up their minds without considering the facts/legal precedents, then they will not spot and/or work to figure out the legal arguments that will win the day -- the legal arguments eventually used in the WOM cases did not sprout out on day one, it was an iterative process.

Asking for exemption from quota will cause this proposal to fail. My suggestion:
Of the 10,000 available visas per year for EB5, only about 3k to 4k are being used. How about if one buy a house and give a minimum $100,000 cash payment (not credit in US), he will get a temporary greencard from the EB5 visa pool. If after 2 years, the house is occupied and owned by the same person without problems with credit, he will get a permanent GC. This is on top of meeting the requirements of the category he is in.

Several Websites(Not RSS/VHP) says Christians are 6% now, Muslims are certainly more than 17-18% as millions of Bangladeshi Infiltirators are unaccounted. It is very evident from the fact as Muslim Votes are the deciding factor in the almost most areas of NorthEast, UP, Bihar & West Bengal and that is the only reason, Samajwadi Party & Congress start the Babri Maszid rhetoric just before elections. As most of the posts I see here problem most people have with congress is their Defacto presidentship to the Nehru Dynasty, without counting their contribution to the country. Corruption in media to cover the family from day to night without holding them responsible for all the mess they have created for India in last 60 years. I would have had no problem with Manmohan Singh if he had ruled our country independently, if "Rahul Gandhi" and "Priyanka Gandhi" & "Sonia Gandhi" had to look into the mirror before endorsing him..They completely made a mockery of our democracy by putting puppets in PM's Office, President's office, CEC, CBI and what not.
